1. Acceptance of Terms

These Terms and Conditions govern your access to and use of the CapitalMatch website, mobile app, lead forms, matching experience, and related services. By using CapitalMatch, you agree to these Terms. If you do not agree, do not use the service.

2. CapitalMatch Is Not a Lender

CapitalMatch is a commercial real estate lending marketplace and lead-matching service. CapitalMatch does not make loans, broker loans where a license is required unless properly licensed, make credit decisions, guarantee loan approval, guarantee rates or terms, or provide legal, tax, investment, or financial advice.

3. Eligibility

You must be at least 18 years old and able to form a binding agreement to use CapitalMatch. You may use the service only for lawful commercial real estate financing purposes and in compliance with applicable laws.

4. Your Information and Responsibilities

• You agree to provide accurate, current, and complete information when submitting forms or booking a call.
• You are responsible for reviewing any lender, advisor, or third-party offer before taking action.
• You understand that estimated rates, lender matches, and summaries are informational and may change.
• You agree not to submit false, misleading, fraudulent, or unauthorized information.

5. Consent to Contact

When you submit your contact information and consent, you authorize CapitalMatch and its lending partners to contact you by phone, email, text message, or similar methods about your commercial real estate funding request. Consent is not required to purchase goods or services. Message and data rates may apply. You may opt out of marketing texts by replying STOP where supported.

6. Lender Matches and Third Parties

CapitalMatch may display lender matches, rate ranges, processing times, and other information based on data you provide and information available to us. Matches are not offers of credit. Any actual loan, rate, fee, term, approval, closing timeline, or condition is determined by the lender or third party and may require additional documentation, underwriting, due diligence, appraisal, credit review, and legal review.

7. Calendly and External Services

CapitalMatch may open Calendly or another external scheduling service so you can book a call. Information may be prefilled to reduce duplicate entry. Third-party services are governed by their own terms and privacy policies, and CapitalMatch is not responsible for their acts, omissions, availability, or content.

8. No Professional Advice

CapitalMatch content is provided for informational purposes only. You should consult qualified legal, tax, financial, insurance, or real estate professionals before making decisions about financing, purchasing, refinancing, developing, or selling commercial real estate.

9. Prohibited Uses

• Do not use the service for unlawful, deceptive, abusive, or fraudulent purposes.
• Do not interfere with, reverse engineer, scrape, overload, or disrupt the service.
• Do not upload malicious code or attempt unauthorized access to systems or data.
• Do not use CapitalMatch to violate another person or business entity's rights.

10. Intellectual Property

CapitalMatch, including its name, logo, design, text, software, and other content, is owned by CapitalMatch or its licensors and is protected by intellectual property laws. You may not copy, modify, distribute, or create derivative works from the service except as allowed by law or with written permission.

11. Privacy

Your use of CapitalMatch is also governed by our Privacy Policy, which explains how we collect, use, share, and protect information.

12. Disclaimers

The service is provided on an as-is and as-available basis. To the fullest extent permitted by law, CapitalMatch disclaims warranties of any kind, including warranties of merchantability, fitness for a particular purpose, title, non-infringement, accuracy, availability, and reliability.

13. Limitation of Liability

To the fullest extent permitted by law, CapitalMatch and its representatives will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, lost revenue, lost data, lost business opportunities, financing outcomes, or third-party conduct arising from or related to your use of the service.

14. Indemnification

You agree to defend, indemnify, and hold harmless CapitalMatch and its representatives from claims, damages, liabilities, losses, and expenses arising from your use of the service, your submitted information, your violation of these Terms, or your violation of applicable law or third-party rights.

15. Changes to the Service or Terms

We may update the service or these Terms from time to time. If we make material changes, we will update the effective date and provide notice where required. Continued use of the service after changes means you accept the updated Terms.

16. Governing Law

These Terms are governed by the laws of the State of New Jersey, without regard to conflict-of-law rules, unless applicable law requires otherwise.
